Event Details

Law and Development is one of nine courses within the RaD Management Program offered by UDI Capital Region. This course is designed to provide participants with a comprehensive understanding of the key legal contracts and issues associated with real estate development. Led by industry professionals from the Capital Region, this course covers a range of essential topics related to real estate law.


Throughout the course, participants will delve into the intricacies of various legal contracts relevant to real estate development. They will gain insights into consulting contracts, agreements with municipalities, and other crucial legal agreements that form the foundation of successful development projects. Participants will learn how to effectively negotiate and draft these contracts, ensuring their projects are legally sound and well-protected.


The course also explores the management of legal conflicts that may arise during the development process. Participants will learn strategies for identifying and addressing legal issues, as well as techniques for resolving disputes and minimizing potential risks. They will develop a strong understanding of the legal frameworks and regulations governing real estate development, enabling them to navigate legal challenges with confidence.


By completing Law and Development, participants will acquire the knowledge and skills necessary to navigate the legal aspects of real estate development.

Three 2-hour modules, held once a week online for three weeks

    Real estate development marketing and sales (pre-sale projects, disclosure statements, purchase contracts, development covenants, and conveyancing)
    Strata corporation development and governance (bare land, residential, mixed-use, phased projects, and strata bylaws)
    Resort offerings (fractional interests, headlease / sublease structures, timeshare hotels, rental pools, and home owner associations)
    All aspects of land titles practice (easements, right of ways, covenants, statutory building schemes, subdivisions, road dedications, and crown land tenure such as foreshore leases)
    Matters arising out of the Real Estate Development Marketing Act, Real Estate Services Act, the Land Title Act, and the Strata Property Act
    Thomas’ practice also includes business and construction law including: incorporations, financing, commercial leasing, commercial agreements, buying and selling businesses, review and drafting of construction contracts, and providing advice on builders lien claims and compliance under the Builders Lien Act.

    Before joining Reed Pope, Thomas articled at a boutique law firm in downtown Vancouver specializing in construction litigation where he represented clients in British Columbia’s Provincial and Supreme Court.

    With 50+ appearances in the British Columbia Court of Appeal, and numerous reported decisions involving development and land law over the last 30 years, John Alexander has a wealth of expertise and experience in appellate practice and trial work.
    John’s primary subject area is in land use law, local government (municipal) litigation, survey, and solutions to complex land title and ownership problems. He has appeared at all levels of the courts in Canada, and in front of many tribunals.
    Previous clients have included landowners, developers, public interest groups, societies, not-for-profit organizations from across the province and, on the odd occasion, government agencies.
    John's current role as counsel at Cox Taylor is to support its lawyers in respect of land litigation and administrative law issues. He provides senior level consultation on client files and appears as counsel on complex cases.
    John is no longer accepting new clients. He welcomes people to contact Cox Taylor to initially consult with other members of the litigation and land development team.

    Jeremy A. Burgess is a Litigation Associate with Reed Pope Law Corporation. Jeremy practices corporate commercial litigation, focusing primarily on disputes concerning real property, construction, commercial contracts and corporate matters.
    Before joining Reed Pope, Jeremy practiced as a corporate commercial litigator in the Okanagan for ten years where he represented clients in the Provincial Court of British Columbia, Supreme Court of British Columbia and British Columbia Court of Appeal. He also represented the Public Prosecution Service of Canada, frequently appearing before the Provincial and Supreme Courts of British Columbia.
    After attending law school at University of Victoria, Jeremy and his wife were thrilled to return to Vancouver Island in 2021. In his free time, Jeremy enjoys playing ultimate frisbee, volleyball and working hard at the gym. Jeremy and his wife enjoy the natural beauty of Vancouver Island and embracing the dizzying number of opportunities the area presents for food and drink lovers.

    Mark Holland RPP FCIP (he/him) is a Principal at Westplan Consulting Group with over thirty years of experience in urban planning and landscape architecture. Mark offers a unique and effective combination of private and public sector skill sets to lead projects from early visioning to policy development, to design and approvals and from financing to construction. A commitment to relentless innovation has driven Mark to challenge and push past the norms in all aspects of his work. He has won numerous awards and is credited with many innovations in Canadian Planning including sustainable communities, Agricultural Urbanism, creating urban vitality through Urban Magnets and many other progressive concepts.

    ​Mark has also made significant contributions as a planning educator. He began as an instructor in the University of British Columbia’s School of Architecture and Landscape Architecture in the early 2000s. Since then, Mark has been a frequent speaker on topics related to planning and sustainability at the University of British Columbia and Simon Fraser University. Perhaps his greatest influence on planning education is the role he played in launching the Master of Community Planning degree at Vancouver Island University (VIU) in 2014. Ever since, he has played an instrumental role in the school, driven by a commitment to ensure that the next generation of planners is prepared to help communities create their future.

    Mark is a Registered Professional Planner with the Canadian Institute of Planners and was inducted into the College of Fellows in 2022.
